Distance Sales Agreement

  1. Scope

This Agreement governs the purchase and sale of Turkish Delights, nuts, dried fruits, tea, and other related products (hereinafter referred to as the “Products“) offered by Elixir Iraq through their website.

  1. Order Placement

The Customer shall place orders for the desired Products through the Online Store’s website. The Customer is responsible for providing accurate and up-to-date information, including delivery address and contact details.

  1. Pricing and Payment

The prices of the Products are listed on the Elixir Iraq’s website and are inclusive of applicable taxes, unless otherwise specified. The Customer shall make payment for the ordered Products using the available payment methods provided on the Online Store’s website.

  1. Delivery

a) Elixir Iraq shall make reasonable efforts to deliver the ordered Products to the Customer within the agreed timeframe. However, delivery times may vary depending on the Customer’s location and other factors beyond Elixir Iraq’s control.

b) The Customer acknowledges that the risk of loss or damage to the Products passes to them upon delivery. It is the Customer’s responsibility to inspect the Products upon receipt and notify Elixir Iraq of any discrepancies or damages within a reasonable time.

  1. Cancellation and Returns

a) The Customer has the right to cancel the order within a specified timeframe, as indicated on the Online Store’s website or as per applicable consumer protection laws.

b) If the Customer receives defective, damaged, or incorrect Products, they must notify Elixir Iraq and return the Products within the specified timeframe for a refund or replacement.

c) Elixir Iraq reserves the right to refuse returns or refunds if the Products have been opened, used, or damaged by the Customer.

  1. Privacy and Data Protection

Elixir Iraq shall handle the Customer’s personal information in accordance with applicable privacy and data protection laws. The Customer agrees to the Elixir Iraq’s Privacy Policy, available on their website.

  1. Limitation of Liability

Elixir Iraq shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the purchase, delivery, or use of the Products, unless caused by their gross negligence or willful misconduct.

  1. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Iraq. Any disputes arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of Iraq.

  1. Entire Agreement

This Agreement constitutes the entire understanding between the Parties with respect to the subject matter hereof and supersedes all prior discussions, negotiations, and agreements, whether written or oral.

By placing an order through the Online Store’s website, the Customer acknowledges that they have read, understood, and agreed to the terms and conditions of this Distance Sales Agreement.
